1. Introduction

These Terms of Engagement set out the basis upon which Mowbray Advisory Limited (“we”, “us”, “our”) will provide immigration advice and/or representation to you (“the Client”).

By instructing us, you agree to these Terms.


2. Our Regulatory Status

Mowbray Advisory Limited is regulated by the Immigration Advisers Authority (IAA), reference number F202431717.

We provide immigration advice and services in accordance with the Immigration and Asylum Act 1999 and the IAA Code of Standards.


3. Scope of Services

We will provide services as agreed in writing (usually by email or engagement letter). This may include:

  • Advice on eligibility and immigration routes
  • Preparation and submission of applications
  • Document review and checking
  • Correspondence with the Home Office
  • Representation within the limits of our IAA authorisation

We do not provide advice outside UK immigration law unless specifically agreed.

If additional work becomes necessary beyond the agreed scope, we will inform you and agree fees before proceeding.


4. Your Responsibilities

You agree to:

  • Provide accurate and complete information
  • Supply requested documents promptly
  • Inform us of any changes in your circumstances
  • Review all documents before submission
  • Pay agreed fees on time

We cannot be responsible for delays or refusals arising from inaccurate or incomplete information provided by you.


5. Fees & Payment

Our fees will be confirmed in writing before work begins.

Unless otherwise agreed:

  • Fees must be paid in advance
  • Government application fees are separate and payable by you
  • Interpreter, translation or expert report costs are additional

Fees are non-refundable once work has commenced, except in accordance with IAA guidelines.

If staged payments are agreed, work may pause if payments are not made on time.


6. No Guarantee of Outcome

While we aim to provide accurate and professional advice, we cannot guarantee the outcome of any application.

Decisions are made solely by the Home Office or relevant authority.


7. Communication

We will communicate with you via email, telephone, or in writing as agreed.

You are responsible for ensuring your contact details remain up to date.


8. Confidentiality

We will treat your information as confidential and process personal data in accordance with UK GDPR and our Privacy Policy.

We may disclose information where required by law or regulatory obligation.


9. Complaints Procedure

We are committed to providing high standards of service.

We will acknowledge your complaint and aim to resolve it promptly.

If you are not satisfied with our response, you may refer the matter to the Immigration Advisers Authority (IAA) in accordance with their complaints procedure.


10. Termination of Instructions

You may terminate instructions in writing at any time.

We may cease acting if:

  • Fees are not paid
  • You fail to cooperate
  • There is a breakdown of trust
  • Continuing would breach regulatory obligations

Any fees earned up to the termination date remain payable.


11. Limitation of Liability

Our liability is limited to the amount of fees paid for the relevant matter, except where prohibited by law.

Nothing in these Terms excludes liability for fraud, dishonesty, or any matter which cannot legally be limited.


12. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the jurisdiction of the courts of England and Wales.
